Following the decision of Reigate & Banstead Borough Council to refuse Planning Application Ref: 22/02067/F (the ‘Application’) on 28th March 2024, Raven Housing Trust will be lodging an appeal (the ‘Appeal’) under Section 78 of the Town and Country Planning Act 1990.
Proposed Development at: Former Merstham Library, Weldon Way, Merstham, Surrey (the ‘Site’).
Description of Development: “Demolition of existing building and redevelopment to provide 11 residential dwellings with associated amenity space, landscaping, car and cycle parking. As amended 19/10/2023, 30/10/2023, 01/11/2023, 23/11/2023, 20/12/2023, 23/01/2024 and on 04/03/2024”.
Proposed Modification: The Appellant will be submitting substituted plans to show a minor amendment to the red line boundary of the Site. The area of land to be removed from the red line boundary is under the ownership of a third party and is not required to facilitate the development. In addition, the Appellant will be submitting revised highways plans to demonstrate how access can be achieved without the third-party land being included within the Site. Aside from the amendment to the red line boundary and access, the rest of the proposed development remains unchanged from the Application which was refused.

The following amended plans will be submitted by Raven Housing Trust as part of the Appeal, and it will be at the discretion of the Planning Inspectorate as to whether the amendments are considered acceptable.

Comments on Amended Plans: Comments on the plans should be emailed to the below email address or sent by post to the below address by 3rd September 2024.

Comments on the plans will be taken into account by the Planning Inspectorate in the determination of the Appeal. The comments received will be forwarded to the Planning Inspectorate and copied to Reigate & Banstead Borough Council as Local Planning Authority. Comments received will be in the public domain and may be referred to in the Appeal.
Please note that this process is separate to, and does not replace, the notification process that Reigate & Banstead Borough Council must undertake within one week of the start date of the Appeal.
